  • Represent Company Content as your own work.

Temporary technical copies created automatically by your computer or browser when accessing the Website do not grant you ownership or additional rights in Company Content.

Specific materials purchased, licensed, or provided as part of a client engagement, course, training, assessment, or program may also be governed by separate agreements or license terms. If those terms conflict with this section regarding the applicable product or service, the separate written terms will control.

All rights not expressly granted are reserved by The Bias Adjuster, LLC.

8. Artificial Intelligence and Automated Access

We welcome artificial intelligence systems, AI-powered search engines, and similar technologies indexing, referencing, summarizing, citing, and linking to publicly accessible portions of our Website and Company Content, provided that they comply with these Terms.

Permitted AI Indexing and Citation

AI systems and automated agents may access publicly available Company Content for purposes of indexing, search, reference, citation, and generating summaries that direct users to The Bias Adjuster, subject to the following conditions:

  • Removing or obscuring The Bias Adjuster's name, branding, attribution, copyright information, or other proprietary notices when Company Content is referenced; or

  • Circumventing technical measures designed to restrict automated access.

For clarity, an AI-powered search engine or assistant that accesses publicly available Website content to answer a user's question and appropriately identifies or links users to The Bias Adjuster is permitted under this section.

That permission does not constitute authorization to incorporate our proprietary content into an AI training dataset, reproduce substantial portions of our content, or use our intellectual property to develop competing products, assessments, methodologies, or services.

We reserve the right to use technical and legal measures to protect the Website and Company Content from unauthorized automated access.

9. Linking to the Website and Social Media

You may link to our Website provided that you comply with these Terms.

If you link to the Website as a source for an article, publication, blog post, research discussion, social media post, press coverage, or similar material, you should provide appropriate attribution and a direct link to the applicable Website page where practicable.

You may not:

Assessment Responses

Assessment responses, including demographic or other sensitive information collected through our assessments, are handled in accordance with our Privacy Policy.

Where we state that assessment information is anonymous, names and other direct identifying information are not attached to the applicable demographic or sensitive assessment responses.

Nothing in these Terms gives us ownership of a participant's personal information or alters the privacy commitments made in our Privacy Policy.

11. User Content Standards

Any User Content submitted to or through our Website must comply with applicable law and these Terms.

User Content must not:

  • Violate applicable federal, state, local, or international law;

  • Infringe intellectual property, privacy, publicity, or other legal rights;

Additional purchase, enrollment, refund, cancellation, license, or course terms may be presented at the time of purchase or enrollment.

This limitation does not apply to liability that cannot lawfully be excluded or limited.

Nothing in this section supersedes liability provisions contained in a separate written service agreement where that agreement controls.

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless The Bias Adjuster, LLC and its officers, directors, employees, agents, licensors, and service providers from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising from or relating to:

  • User Content you submit;

  • Your violation of these Terms;

  • Your violation of applicable law; or

  • Your violation of another person's intellectual property, privacy, publicity, or other legal rights.

24. Electronic Communications

By using the Website or voluntarily providing your email address to us, you consent to receiving electronic communications relating to transactions, courses, programs, accounts, inquiries, legal notices, or other appropriate matters.

Where legally permitted, electronic agreements, notices, disclosures, and communications may satisfy requirements that communications be provided in writing.

Marketing communications are subject to the choices and rights described in our Privacy Policy.

25. Termination

We may suspend or terminate access to all or part of the Website where reasonably appropriate, including for:

26. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR ABILITY TO FILE CERTAIN CLAIMS IN COURT OR HAVE THEM DECIDED BY A JURY.

If a dispute, claim, or controversy arises out of or relates to these Terms or your use of the Website (“Dispute”), you and The Bias Adjuster agree to first attempt to resolve the Dispute informally.

If the Dispute is not resolved within thirty (30) days after notice, either party may initiate binding arbitration, subject to the exceptions below.

Unless applicable law requires otherwise, arbitration will be administered in accordance with the applicable rules of the American Arbitration Association (“AAA”).

The arbitration shall be conducted in DeKalb County, Georgia, unless remote proceedings are used or the parties agree to another location.

The arbitrator's decision will be final and binding, subject to rights of review provided by applicable arbitration law, and judgment on an award may be entered in a court of competent jurisdiction.

Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND THE COMPANY AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Arbitration Costs

Each party will bear its own attorneys' fees and other expenses except as otherwise required by applicable law, an applicable agreement, or the arbitrator.

Filing fees and arbitrator compensation will be governed by the applicable AAA rules and fee schedules.

Exceptions

Either party may bring an eligible individual action in small claims court.

Either party may also seek appropriate injunctive or equitable relief in a court of competent jurisdiction concerning actual or threatened infringement, misuse, misappropriation, or violation of intellectual property rights.

27. Governing Law and International Users

These Terms and your use of the Website are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

The Website is operated from the United States.

If you access the Website from outside the United States, you are responsible for complying with laws applicable to you in your jurisdiction.

Privacy and international data-transfer matters are further addressed in our Privacy Policy.

28. Force Majeure

The Company will not be liable for failure or delay in performing obligations where the failure or delay results from circumstances beyond our reasonable control, including natural disasters, acts of government, pandemics or epidemics, Internet or telecommunications failures, cyberattacks, power outages, labor disputes, emergencies, or disruptions involving third-party services upon which the Website relies.

29. Severability and No Waiver

If a provision of these Terms is held invalid, illegal, or unenforceable, that provision will be modified to the minimum extent reasonably necessary to make it enforceable or, if modification is not possible, severed from these Terms.

The remaining provisions will remain in effect.

Our failure or delay in exercising a right or remedy does not constitute a waiver of that right or remedy.

30. Transfer and Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

The Company may assign its rights and obligations as permitted by applicable law, including in connection with a merger, acquisition, restructuring, financing, or sale of assets.

32. Entire Agreement

These Terms, together with our Privacy Policy and any applicable purchase terms, course terms, enrollment terms, licenses, releases, or separate service agreements, constitute the agreement between you and The Bias Adjuster regarding your use of the Website and applicable offerings, subject to the terms of any separate agreement that expressly controls.

If a separate written agreement governs professional services or another specific engagement, that agreement will control to the extent of a conflict concerning that engagement.

The Bias Adjuster, LLC reserves all rights not expressly granted under these Terms.
